Fiji feels the lawsuit is pointless

The Fiji Water Girl is now suing Fiji, the company that made her famous at the Golden Globes. The company does not feel her lawsuit makes sense.

Court documents obtained by E! have revealed that Kelleth Cuthbert, who is more popularly known as the Fiji Water Girl after her photobombs at the Golden Globes, is suing Fiji. The lawsuit is based on “the unauthorized use of [Fiji Water Girl’s] photographs, likeness, and identity.” She is suing over the company’s use of her Golden Globes moment for their international marketing.

According to documents, Cuthbert said she did not give Fiji permission to create cardboard cutouts of herself and use them for marketing. She added that she did not “sign away her rights to ‘Fiji Water Girl.'” However, the brand tried to get her to do so and pressured her into signing a “fake document” authorizing her image use.

In a statement to E!, Fiji said, “This lawsuit is frivolous and entirely without merit. After the Golden Globes social media moment, we negotiated a generous agreement with Ms. Cuthbert that she blatantly violated. We are confident that we will prevail in Court. Throughout our history, we have had a sterling reputation working with talent.”

Some people thought Cuthbert’s stint at the Golden Globes was hilarious. However, others did not like it. Jamie Lee Curtis took to Instagram to say that she “specifically moved away from the blatant” advertising. But ended up being involved anyway.

“I knew why there was a photographer poised there. I moved away as I said out loud that I didn’t want to be doing advertising for either,” the Halloween star claimed. “Clearly this angle shows that I moved from her being behind me and yet from the side it still happens.”

Cuthbert has not talked about the lawsuit personally herself.
