A spokesperson for the Los Angeles County Superior Courts told E! that Kutcher is “expected to testify” in the case against Gargiulo, a 43-year-old notorious killer who murdered 22-year-old Ashley Ellerin during the course of her relationship with Kutcher.

Gargiulo is facing two counts of murder and one of attempted murder. Kutcher’s testimony in the case is necessary to establish the timeline of events that led to his ex being stabbed dead 47 times on the 2001 evening she planned to attend Grammy after parties with Kutcher.

In his statement to the police at the time, Kutcher said he called her many times that night but she did not pick up. After that, he went over to her apartment. No one answered the door, after which he looked through the window to find a pool of wine which later turned out to be blood.

Since Kutcher assumed it to be wine, he left the residence at that time. Ellerin’s roommate later discovered her dead body lying in a pool of blood. At the time, her murder went completely unsolved. It was much later that detectives were able to connect the 2001 murder to the death of 32-year-old Maria Bruno and attempted killing of Michelle Murphy. All of these were done by Gargiulo, and the connection was made after Murphy’s murder went unsuccessfully.

The New York Times reported, “One of Gargiulo’s attorneys has previously said Gargiulo denies any involvement in the killings. Though he lived near all the victims, that doesn’t make him guilty.”

Gargiulo also faces murder charges in Illinois for the killing of Tricia Pacaccio.
